What is Notary? · Buying process

Notary

In Quebec a property purchase is signed before a notary, not a lawyer: the notary prepares the deed of sale and the deed of hypothec, verifies title and transfers the funds. The fees are part of closing costs.

The buyer chooses and pays the notary. Budget between $1,500 and $2,500 depending on the transaction. The notary also registers the hypothec in the Land Register and hands you, after signing, the keys and the statement of adjustments (municipal and school taxes, condo fees).

Some Montreal notaries serve in Spanish; ask if it reassures you, even though the deeds are drafted in French or English.
